Description of the residences, hotel, recreational areas and amenities, such as the, spas, fitness centers and restaurants, for The Preserve at Botany Bay, One Steamboat Place and Castello di Casole, are based on current development plans and are subject to change without notice. There is no guarantee or representation that such components will be constructed as depicted, in whole or in part, or will become part of the Timbers Collection and/or the Timbers Reciprocity Program.


1. General

This Privacy Policy (this “Policy”) covers only the Timbers Resorts (also referred to as “our”, “we”, or “us”), Timbers Reciprocity Program site (referred to hereafter as “Site”).

Timbers Resorts is committed to protecting your privacy and that of other visitors to this Site.

This Policy is effective as of August 1, 2008.

2. Collection of Information – Generally

The Site may use technology that collects personally identifiable information from you, such as name, address, telephone number and email address. The Site may use cookies, but does not use clickstream, web bugs, spyware or adware. By entering the Site and providing information, you agree to the collection, use and storage of the information described herein.

Any personal information we may collect is not shared or sold with any person or entity outside of Timbers Resorts, unless ordered by a court or required by law.

If you want to review or change any information you submitted to us, please call the person to whom you submitted the information by email or login to your account. If you cannot reach the specific person, please contact us at (970) 963-4626. We take reasonable steps to make sure that that information you provided to us remains reliable and accurate, but we cannot guarantee that.

While we take the issue of protecting your privacy online seriously, you should exercise discretion in what information you send to us by email. We cannot guarantee that email sent over the Internet is secure and therefore it may be intercepted by others before it reaches Timbers Resorts. If you are concerned about sending any information to us by email, please send us a letter by mail or call us using the contact information at the bottom of this Policy. We are not responsible for the security of information contained in emails sent over the Internet.

3. Collection of Information - What We Collect

The following are the types of the information we may collect from you:

Anonymous Site Traffic:

Timbers Resorts may from time to time use technology to track Internet traffic to its Site, including traffic to specific sub-pages. For example, we may track the number of visitors to the Site over a given period, or track how long a visitor visits/views a specific sub-page of the Site. The tracking information is collected anonymously, so no personally identifiable information is collected about any visitor to the Site. In other words, the tracking information cannot be related to a specific visitor of the Site. This tracking information is used by us for internal marketing and Site improvement efforts.

Submissions By Email:

There are several email addresses on the Site that you can use, at your sole option, to contact specific Timbers Resorts personnel regarding general inquiries. The use of the email addresses to contact us in entirely voluntary and it is your choice as to what information you send us except as prohibited herein. If you chose to contact us by email, please only provide us with the minimum contact information we need to respond back to your inquiry such as name and telephone number/email address. Any information you provide to us through email will only be used for the limited purpose of analyzing and responding to your inquire. Only after your specific approval and consent will we create any files and store the information for future use in accordance with our general privacy guidelines.

4. Who Should Use This Site

This Site is designed for general information regarding the Timbers Reciprocity Program and to provide a platform for members of the Timbers Reciprocity Program to exchange information and use rights of real estate properties. This Site is designed to provide such information to adults 18 years of age or older.

5. Amendments and Changes to This Policy

Any changes, deletions, amendments or other revisions to this Policy will be posted on this Site under this section of the Policy for a period of 10 days and will be effective when posted. The changes, deletions, amendments or other revisions will also be immediately incorporated into the Policy text at the appropriate place(s). Your continued use of this Site following the posting of any changes, deletions, amendments or other revisions shall constitute your acceptance of the change(s), deletion(s), amendment(s) or other revision(s). If you are concerned about future changes, deletions, amendments or other revisions to this Policy, you should check back to this Site and Policy periodically.

If any of our changes, deletions, amendments or revisions affects how we treat information provided to us by email submissions, we will notify you and give you 30 days to opt out of the change, deletion, amendment or revision as it pertains to your information. If we decide in the future to share any of the information we collect through this Site with any third parties, we will require that our Policy be adhered to before any such sharing.

Our Site has industry standard security measures in place to protect against loss, misuse and/or alteration of any information or content under our control that is on, or accessible or collected through, our Site, including security procedures meant to prevent hacking or other unauthorized access to our Site. While "perfect security" on the Internet does not exist, we do take reasonable steps to secure our Site and computer systems. In any event, Timbers Resorts cannot guarantee the security of the Site and shall have no liability with respect to security breaches. By using the Site, you agree to assume all risks described herein.

Our Site may contain links to external, third party sites. Timbers Resorts is not responsible for the privacy practices or policies or the content of such other third party sites. You should consult the privacy policies of those third party sites for details.

8. Advertising

At the present time, Timbers Resorts does not use any advertising server companies or services in connection with the Site. There is no third party advertising on the Site.

Collection and Use of Information

Timbers collects personal information that you provide through the Internet, email, mail, facsimile, telephone or otherwise. Timbers is the owner of the information collected from you. We will not sell or rent this information to any third party unaffiliated with Timbers without your consent; except that we may share your personal information with third parties that (1) help manage our databases, customer lists and email lists; (2) allow us to provide special offers (including offers through corporate partners) or other information to you; (3) help us perform our contractual obligations to you; or (4) have a right to such information pursuant to applicable laws or court orders.

We will use personal information collected to provide you with information from us, including sales and marketing materials, and to address matters raised in any communications that you may have with us.

Use Data:  If you use our internet sites, we may collect non-personally identifiable information about your use of the sites (such as IP addresses, domains, browser type and version, and operating system).

Cookies:  A cookie is a small file stored on a user's computer that contains information about the user. When using our internet sites, we may use either session ID cookies and/or persistent cookies. A session ID cookie terminates once a user closes the browser. A persistent cookie is a small text file stored on a user's hard drive for an extended period of time. Timbers may amend this Privacy policy at any time in its sole discretion, subject to any applicable laws. Please review this Privacy Policy periodically to confirm your continued agreement with the terms contained herein, as the same may be amended from time to time.
